Govt Reducing Pending Company Law Cases, Says FM Sitharaman
As Finance Minister Nirmala Sitharaman stated on Monday, the Ministry of Corporate Affairs (MCA) has taken significant steps to reduce company law litigation. Sitharaman, who is also the Union Minister of Corporate Affairs, told the Lok Sabha that a special drive in 2017 resulted in the withdrawal of 14,247 prosecutions, and a second special drive in 2023 will identify 7,338 compoundable cases for withdrawal. 6,294 withdrawal requests had been submitted to various courts as of July 15, 2024. However, the minister emphasized that prosecution would continue for serious or non-compoundable offenses.
The MCA has been looking at prosecutions that are still pending in various courts. In 2017 and 2022, senior ministry officers formed committees to recommend that prosecutions be dropped. The objective is to free judicial courts from technical and procedural violations so that they can concentrate on more serious cases. An adjudication process may be used to address technical and procedural issues.
The Companies and Limited Liability Partnership (LLP) Acts have been decriminalized by the MCA for 63 reasons, including facilitating business transactions and strengthening corporate governance.
